The lone exception is the Dubai International Financial Centre (&#8216;DIFC&#8217;) free zone, which has its own property rules and keeps a separate property record for real estate located there.<\/p>\n<p>On March 13, 2006, the Government of Dubai published Law No. 7 of 2006 respecting Real Property Registration in the Emirate of Dubai (&#8220;Property Ownership Law&#8221;), which governs property ownership by people and businesses in the Emirate of Dubai.<\/p>\n<p>According to Article 4 of the Property Ownership Law, UAE and GCC nationals, as well as companies incorporated in the UAE (excluding free zones) and wholly owned by UAE or GCC nationals, have the right to own freehold rights to <a href=\"https:\/\/www.reyeselsamad.ae\/\" target=\"_blank\" rel=\"noopener\">real estate<\/a> and acquire all types of real estate holdings such as usufruct, musataha, and long-term leases up to 99 years residing in any area of the Emirate of Dubai.<\/p>\n<p>Moreover, public joint stock firms can own property anywhere in Dubai. According to our experience, public joint stock firms that are listed in Dubai or elsewhere in the UAE or GCC are permitted by the DLD to hold real estate anyplace in Dubai.<\/p>\n<p>A company registered in the UAE that has non-UAE or GCC shareholders is not considered a UAE or GCC national under Article 4 of the Property Ownership Law. Article 4 of the Property Ownership Law permits non-UAE or GCC nationals and businesses to own freehold title, a long lease, or a usufruct right for up to 99 years in Dubai regions designated for foreign ownership by Ruler of Dubai rules (&#8216;Designated regions&#8217;). Article 4 of the Property Ownership Law is supplemented by DLD policies, which are not legally published and are susceptible to change over time. A quick explanation of the current DLD policy is provided below:<\/p>\n<ol>\n<li><strong><u>Foreign Investors<\/u><\/strong> are not currently permitted to directly own real estate in the Designated Areas.<\/li>\n<\/ol>\n<p>However, a foreign firm can form a company in the JAFZA or another free zone authorized by the DLD from at any time, and can register the real estate it plans to acquire in the name of the Dubai free zone company so established.<\/p>\n<p>The DLD and DIFC administration recently signed a memorandum of understanding, allowing DIFC-incorporated firms to directly hold real estate outside the free zone within Designated Areas.<\/p>\n<ol start=\"2\">\n<li><strong><u>Foreign investors or funds<\/u><\/strong> (offshore or onshore) are not permitted to own real estate in the Emirate of Dubai.<\/li>\n<li><strong><u>UAE\/GCC nationals<\/u><\/strong> and near the shore companies wholly owned by them (such as limited liability companies or sole formation registered with DED) can purchase real properties directly in their individual capacity in the Emirate of Dubai.<\/li>\n<li><strong><u>Non-UAE\/GCC nationals<\/u><\/strong> and companies can form a free zone company in Dubai, such as JAFZA or other DLD-approved free zones, and register the real estate in the name of the Dubai free zone company.<\/li>\n<\/ol>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-94d6995 elementor-widget elementor-widget-heading\" data-id=\"94d6995\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">How to Register Joint Ownership in Dubai<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-83f9aa4 elementor-widget elementor-widget-text-editor\" data-id=\"83f9aa4\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>RERA&#8217;s responsibility in supervising jointly owned assets is broad, encompassing budget authorizations, registration of owners&#8217; associations, and dispute resolution. RERA&#8217;s active engagement in 2024 involves ensuring that parties comply with property regulations.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-addff86 elementor-widget elementor-widget-heading\" data-id=\"addff86\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">DLD Process and Fees<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-805e001 elementor-widget elementor-widget-text-editor\" data-id=\"805e001\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>RERA is also in charge of approving the annual budget for service charges, as well as fees for common area upkeep and administration.
